Tite late Judge Blackman was very particular in requiring attorneys to observe the rules of practice. In a certain cause Lawyer T. had sued out a writ of capias. Lawyer L. moved to quash the writ, and was proceeding with his argument, when the Court interrupted him with the following query : Tue Court: What are you reading from, sir? Lawyer L.: From work on logic. your honor. Tur Court: Did you give Brother T. notice that you were going to read from a work on logic ? Lawyer L.: Ofcourse not, your honor. Tut Court: Are you aware, sir, of the rule of court which requires notice to be given of matter which would be liable to surprise the attorney on the other side? Lawyer L.: Yes, your honor; but the rule has no application to a matter of this kind. Tue Court: I don't know, sir; 1 don't know. 1 know of nothing that would surprise Brother T. more than logic, and if you haven't given him notice that you are going to read from a work on logic, why [can't permit you to read it.
