An Interesting decision was rendered recently by Judge ownsend in the Cited States Cireutt Court In this district in the case of the Amertean Waltham Wateh Company vs. Joseph H. Sandman, Cotpiatnant is the well-known manu- facturer of Waltham watches at Waltham, Mass, From the opinion, It appears that complainant since 1834 has sold nearly $,000,000 watch movements, all of which, with few ex- ceptions, have borne the name “ Waltham. That originally the name Waltham was used tn a geographical sense, but that, by long-continued use, It has acquired a secondary meaning as a designation of complainant's watches ; that ta 1805 one E. A. Locke, for whom the defendant was the sole selling agent, began te manufacture of watches at Waltham under the name of Columbia Watch Company ; that said Locke, who was nota resident of Waltham, stated that he should locate his business there because the word “Waltham” | had come tobe known all over the world through the watches made by the complainant, and “because the word + Waltham * would sells watch.” The opinion states farther that the watches made by the sald Locke aud sold by the defendant, which were usually marked “Columbla Watch Company, Waltham, Mass.,” were stamped with much higher humibers than the amount actually manufactured called for, So as to suggest, together with the name Waltham, the older and original manufacture of watches made by complainant. ‘The complatnant asked that the defendant be enjotned from using the word “Wattham" upon watches sold by him, with- out some accompanying statcment clearly distinguishing them from the watches manufactured hy the complalnant.
