The complaint, in effect, was that the said Merrick, of the state of North Carolina, did violently, with force arms, feloniously, with malice afore- ught, ete., lay hands upon the said elton and feloniously attempt to said Melton in front of a rapidly. wing street-car, with the intent, ete., converting the said Melton into a mory, as aforesaid.
